State law defines county health services as public health services, outpatient health services, and inpatient health services provided directly or purchased by a local jurisdiction. Mental health services and alcohol and drug abuse services are not county health services. (Welfare and Institutions Code (W&IC) §16801 (a)) The Program and Reserve Account is part of the CMSP account. (Subsections (f) and (g))

State law permits counties with contracts with DHS during the 1990-1991 fiscal year under W&IC §16709, and counties with populations under 300,000 (1990 Census), to contract with DHS to administer county health services. Subsection (d) provides that DHS shall establish the CMSP account. Subsection (j) sets forth jurisdictional risk limitations. These limitations cover the following counties: Alpine, Amador, Butte, Calaveras, Colusa, Del Norte, El Dorado, Glenn, Humboldt, Imperial, Inyo, Kings, Lassen, Madera, Marin, Mariposa, Modoc, Mono, Napa, Nevada, Plumas, San Benito, Shasta, Sierra, Siskiyou, Solano, Sonoma, Sutter, Tehama, Trinity, Tuolumne, Yuba; and Lake Mendocino, Merced, Placer, San Luis Obispo, Santa Cruz, and Yolo. The County Medical Services Program (CMSP) was enacted through legislation from the passage of Proposition 99. The program provides medical and dental services for medically indigent adults and county residents with undetermined citizenship status. Dental benefits reimbursement rates for CMSP are equal to the scope of Denti-Cal benefits for adults (ages 21 to 64), effective August 1, 2000. Procedures available under CMSP therefore exclude sealants and orthodontic services. Other Denti-Cal procedures that are provided primarily to children (for example, procedures 600 through 603) are included in the scope of CMSP dental benefits, since some adults (such as those with over-retained primary teeth) may require these services. Treatment Authorization Requests and claims for services provided to CMSP beneficiaries should be submitted to Denti-Cal for processing.
