Title 22 California Code of Regulations (CCR) §50273(a)(9) provides that individuals between the ages of 21 and 65 who are in an IMD shall be considered inmates of a public institution and are not eligible for Medi-Cal until they are unconditionally released.

The CDHS has advised Administrative Law Judges in the past that inpatients of IMDs are eligible for Medi-Cal. This is not correct. The CDHS has determined that per Title 22 CCR §50273(a)(9), inpatients of IMDs are not eligible for Medi-Cal.
