Ramos v. Myers Issues

AID PENDING

Title 22, CCR §50953 provides that hearings are to be conducted in accordance with Division 22 of the Manual of Policies and Procedures (MPP). MPP §22-073.11 states that if a claimant has filed a timely request for hearing, the county must issue aid paid pending within five working days of the receipt of the hearing request by the appropriate agency. MPP §22-001(c)(4) makes clear that the CDHS as well as counties must issue aid paid pending in accordance with MPP §22-073.11.

The CDSS and CDHS have been working together to make sure that CDHS issues aid paid pending to claimants in Ramos hearings. If a judge needs to make an aid pending order in a Ramos case, either to order or discontinue aid pending, the judge should send the aid pending order to Ramos Hearings c/o Carol Davis at Mail Station 19-36. Carol will be responsible for forwarding any aid pending order to CDHS.
