ACWDL 91-78 requires the county to provide Medi-Cal spenddown information with the Medi-Cal application. This spenddown information is contained in the MC 007 form. No substitute forms are permitted.
If any county uses a substitute form, the county has not properly informed the claimant of spenddown procedures. Judges should grant a claim in any case where the county has denied an application due to excess property (other than cases where the excess property was held in a retroactive month) where the county has failed to provide the Medi-Cal applicant with the MC 007. (The county is also required to give oral instructions about property spenddown at the face-to-face interview.)
Judges should order the county to give the claimant 30 days to accomplish property spenddown.
