CDSS ACL 97-29 -- April 30, 1997 (Synopsis): Maximum Family Grant (MFG) -- Aid to Families with Dependent Children (AFDC)

New Manual of Policies and Procedures (MPP) §44-314, which becomes effective August 1, 1997, provides that the Maximum Aid Payment (MAP) will not be increased for any AFDC Assistance Unit (AU) that has received AFDC continuously for the ten months prior to the birth of a child when the child is born on or after August 1, 1997. Aid will be considered continuous for the ten months prior to the birth of the child unless there was at least a two month break in aid during that period.

The MFG will not apply to children conceived as a result of a rape or incest if the rape or incest was reported to law enforcement, a medical or mental health professional, or a social services agency within three months after the child’s birth. In the case of incest, if paternity was established, a report need not be made.

The MFG will also not apply to any AU where the child was conceived as a result of contraceptive failure if the parent was using an intrauterine device, a Norplant, or the sterilization

of either parent. Medical verification would be needed to prove the failure of the above contraceptive devices.

The MFG will also not apply if the child was conceived "while either parent was an unaided, nonparent, caretaker relative." For example, if a non-needy aunt is receiving AFDC for her niece, and then has a child of her own, the MFG would not apply and the aunt could receive aid for her own child.
