- Withdrawal
A withdrawal is an agreement by a claimant or authorized representative to withdraw one (1) or more issues raised in a hearing request.
A withdrawal may be conditional or unconditional. A conditional withdrawal is made on the condition an agency (e.g., a county) perform specified action(s). In some cases, a conditional withdrawal may also require the claimant to perform an act such as providing a specific document before the county is required to perform a specified action such as reevaluate eligibility. An unconditional withdrawal is made without any conditions.
A withdrawal may be full or partial. A full withdrawal withdraws all issue(s) raised in a hearing request. A partial withdrawal withdraws at least one (1) but not all issues raised in a hearing request.
Because a partial withdrawal does not withdraw all issues raised in a hearing request, the remaining issue(s) must still be adjudicated.
If an unconditional full withdrawal is filed before a scheduled hearing, the hearing is canceled.
If a unconditional full withdrawal is filed at or after a hearing, a decision need not be prepared.
- Witness
A witness is an individual who attends a hearing or is asked to attend a hearing for the purpose of providing evidence.
A witness may appear voluntarily at the request of a hearing party or may be subpoenaed to appear. A witness presented or subpoenaed by one hearing party may be cross examined by another hearing party and/or an authorized representative.
