Intentional Program Violation (IPV)

An IPV includes intentional actions, statements, etc., committed by a AFDC and/or FS recipient. A recipient determined to have committed an IPV is disqualified from receiving AFDC and/or FS benefits for a specified period.

CDSS judges conduct ADHs to determine if an IPV(s) was committed. A county seeking to disqualify a recipient may request an ADH and present evidence at the ADH proving the recipient committed an IPV. Based on the evidence presented, a CDSS judge will determine if the recipient committed an IPV.

CDSS judges conduct ADHs, not IPVs. An IPV is not a hearing.
